اگر اصل‌ساز به طور صریح هرگونه اثر حقوقی «داده‌پیام» را مشروط به تصدیق دریافت «داده‌پیام» کرده باشد، «داده‌پیام» ارسال نشده تلقی می‌شود، مگر آن‌که تصدیق آن دریافت شود.
